Rights are fundamental only because God created man with certain unalienable rights. Those rights do not have to be named or set out by man. They simply need to be understood. The wholly revolutionary notion that government's function is to protect those rights forms the basis of American liberty and opportunity.

Take God out of government, out of the analysis, then there are no fundamental rights.
