In the West, when we are sure you must be guilty of something but just can't prove it, we pull our trusty legal rabbits out of our collective hats, obstruction/perversion. In the U.S. we call it obstruction of justice as with Scooter Libby. In Britain we call it perversion of justice as with Rebekah Brooks. Comrade Stalin remains the unassailable model of show trial expertise and we pale in his shadow but we do try. If we cannot prove that you committed a crime, we can still throw you in jail for obstructing our investigation which did not prove your guilt. There is always a way to punish our enemies while making a name for ourselves.
